Late Fee Checker — Oregon
Short answer
Oregon (ORS 90.260): a 4-day grace period, the fee must be in the written rental agreement, and the fee is 5% of periodic rent for each succeeding 5-day period, not a single flat 5% cap. Example: $2,000 rent paid 11 days after the due date = 7 days late after grace = 2 periods × $100 = $200.

Formula and counting convention
Grace end date = due date + 4 days. Rent is late on the next day (due date + 5 days).
Days late after grace = paid date − grace end date, if the paid date is after the grace end date; otherwise 0.
Counting convention — stated explicitly: each started 5-day period counts as a full period. Number of periods = ceiling(days late after grace ÷ 5). There is no silent rounding down: 1 day late after grace = 1 period; 5 days = 1 period; 6 days = 2 periods.
Fee due under this structure = number of periods × 5% × periodic rent.
Written-agreement requirement: under ORS 90.260 the fee must be in the written rental agreement. Check the lease's written fee term before relying on this calculation.
Worked examples
Example 1 — the required test: Rent $2,000, 5% per 5 days, paid 11 days after the due date. Grace end = due + 4 days, so days late after grace = 11 − 4 = 7 days. Periods = ceiling(7 ÷ 5) = 2 started periods. Fee = 2 × 5% × $2,000 = 2 × $100 = $200.
Example 2 — within grace: Rent $2,000, due 2026-10-01, paid 2026-10-04. Grace end = 2026-10-05. Paid on or before the grace end date, so days late after grace = 0 and fee under this structure = $0.
Example 3 — first period, then a second period starts: Rent $1,500, due 2026-10-01, paid 2026-10-11. Grace end = 2026-10-05. Days late after grace = 6. Periods = ceiling(6 ÷ 5) = 2. Fee = 2 × 5% × $1,500 = $150. Note that 5 days late after grace would be 1 period ($75); the 6th day starts the second period.
Example 4 — exactly one period: Rent $1,500, due 2026-10-01, paid 2026-10-10. Grace end = 2026-10-05. Days late after grace = 5. Periods = ceiling(5 ÷ 5) = 1. Fee = 1 × 5% × $1,500 = $75.
Limitations
- Only Oregon's structure above is verified for this tool. All other states return “Check official source” with no fee amount.
- Totals here follow the counting convention stated above, so they can exceed 5% of one month's rent if more periods elapse.
- Daily and flat fee structures exist and are not calculated here; they depend on the written agreement terms.
- The fee must be in the written rental agreement (ORS 90.260). If the lease has no such written term, do not rely on this calculation.
- This tool does not decide whether rent was in fact late, whether payment was received on the date entered, or whether any other remedy applies.
- Local ordinances may be stricter and may override state rules.
